THE SERVICES ARE PROVIDED “AS IS”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

18) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR SUPPLIERS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100.

19) Indemnification

You will indemnify and hold us harmless from claims, damages, and costs (including reasonable attorneys’ fees) arising from your misuse of the Services or violation of these Terms.

20) Governing Law & Venue

21) Dispute Resolution & Arbitration

  • Opt-out: You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@checkinfonow.com with subject “Arbitration Opt-Out”.
  • Exceptions: Either party may seek injunctive relief for IP or security matters in court.

22) Suspension & Termination

We may suspend or terminate access for violations of these Terms, risk to the Services, or non-payment. You may stop using the Services at any time. Sections that by nature should survive termination will survive.

23) Export & Sanctions Compliance

You represent that you are not subject to sanctions and will not use the Services in embargoed countries or in violation of export laws.

24) Miscellaneous

  • Electronic Communications: We may send notices electronically.
  • Assignment: You may not assign these Terms without our consent; we may assign in connection with a merger, acquisition, or sale of assets.
  • Severability: If any provision is unenforceable, the rest remain in effect.
  • Waiver: A failure to enforce is not a waiver.
  • Force Majeure: Neither party is liable for delays due to events beyond reasonable control.
  • Entire Agreement: These Terms and referenced policies constitute the entire agreement.
